Terms of Service

1. Scope

These Terms of Service apply to the use of the NIS2coPilot platform (hereinafter “Platform”), operated by Daniel Weller, DW Digital Ventures, Hauptstraße 18, 36341 Lauterbach-Maar, Germany (hereinafter “Provider”).

By registering or using the Platform, the user accepts these Terms. Deviating terms of the user are not recognised unless the Provider expressly agrees to their validity in writing.

2. Description of Services

NIS2coPilot is a web-based SaaS platform that supports companies in implementing the NIS2 Directive. The Platform provides, in particular:

  • Gap analysis to assess NIS2 compliance maturity
  • AI-powered action recommendations
  • Document generator for security policies
  • BSI registration assistant
  • Training modules

The exact scope of features depends on the chosen plan (Free, Starter, Professional). The Provider reserves the right to further develop the Platform and expand its functionality. Material restrictions to existing features will be announced with reasonable notice.

3. Contract Formation and Registration

The contract is formed upon successful registration on the Platform. The user commits to providing truthful information during registration and to keeping their login credentials confidential.

The user is responsible for all activities carried out under their account.

4. Prices and Payment

Current prices are available on the Platform under “Pricing”. All prices are in Euros and include statutory VAT.

Paid plans are billed monthly in advance via the payment provider Stripe. The user authorises the Provider to collect due amounts via the payment method stored with Stripe.

The Free plan is available indefinitely at no cost. The Provider reserves the right to adjust the scope of the Free plan.

5. Contract Duration and Cancellation

Paid plans have a term of one month and are automatically renewed for another month unless the user cancels before the end of the current term.

Cancellation can be made at any time via the account settings on the Platform or by email to [email protected]. After cancellation, access remains active until the end of the paid period.

The free plan can be terminated at any time without notice by deleting the account.

6. Availability

The Provider strives for the highest possible availability of the Platform. 100% availability is technically not feasible. Maintenance work will be carried out outside normal business hours where possible and announced in advance.

The Provider is not liable for interruptions caused by force majeure, third-party service disruptions, or circumstances beyond their control.

7. Usage Rights and Obligations

The Provider grants the user a simple, non-transferable right to use the Platform for the duration of the contract.

The user commits to:

  • Using the Platform only within applicable laws
  • Not entering false or misleading data
  • Keeping login credentials confidential
  • Not conducting automated access (bots, scrapers) on the Platform
  • Not using the Platform in a way that impairs its functionality

8. No Legal Advice

The Platform provides information and tools to support NIS2 compliance. The content, recommendations, and generated documents provided do not constitute legal advice and do not replace consultation with a qualified lawyer or advisor.

AI-generated content may contain errors. The user is obligated to independently review all generated documents and recommendations before use.

9. Liability

The Provider has unlimited liability for damages resulting from injury to life, body, or health, as well as for wilful intent and gross negligence.

In cases of slight negligence, the Provider is only liable for breach of material contractual obligations (cardinal obligations). Liability in this case is limited to the foreseeable, contract-typical damage.

The Provider is not liable for damages caused by erroneous AI-generated content, incomplete compliance recommendations, or the user's failure to meet statutory deadlines.

10. Data Protection

Personal data is processed in accordance with our Privacy Policy. By registering, the user consents to the data processing described therein.

11. Changes to Terms

The Provider reserves the right to amend these Terms with reasonable notice. Changes will be communicated to the user by email. If the user does not object within 30 days of receiving the notification of changes, the amended Terms are deemed accepted. The user will be separately informed of this right to object and the consequences of silence in the notification.

12. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, insofar as legally permissible, the registered office of the Provider.

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected.
